These Website Terms & Conditions ("Terms") govern your access to and use of credencera.com and related online forms and communications operated by Credence Risk Advisors Inc. ("Credence," "we," "us," or "our"). By using the website, you agree to these Terms. If you do not agree, do not use the website.
Website content is provided for general informational purposes and does not constitute legal, tax, financial, or individualized insurance advice. Insurance products, eligibility, coverage, limits, exclusions, pricing, availability, and underwriting requirements vary by carrier and jurisdiction. You should review the actual application, quote, binder, declarations, endorsements, and policy documents.
Submitting a website form, email, voicemail, text message, document, premium, or quote request does not bind, issue, renew, reinstate, cancel, or modify insurance coverage. Coverage is effective only when confirmed by Credence or the applicable insurance carrier through authorized written documentation and after all required conditions are satisfied. Do not use the website, email, or text messaging for urgent coverage changes, claims emergencies, or time-sensitive cancellation or reinstatement requests.
Quotes are estimates based on information available at the time and are not guarantees of price, eligibility, or coverage. All quotes and applications are subject to verification, underwriting, carrier approval, applicable filings, and payment requirements. You agree to provide complete, current, and accurate information and to promptly correct material changes. Misstatements or omissions may affect pricing, eligibility, coverage, or claim handling as permitted by law.
Credence is an independent insurance agency and may access products from multiple insurers, MGAs, wholesalers, or programs. Insurance coverage is provided by the issuing carrier—not by Credence. Carrier policy documents control if website content, a summary, or a communication conflicts with the issued insurance contract.
You may use the website only for lawful purposes and only if you can form a binding agreement. You may not interfere with website operation or security; introduce malicious code; attempt unauthorized access; scrape or copy content through automated means without permission; impersonate another person; submit false or fraudulent information; or use the site in violation of law or another person’s rights.
By communicating with us electronically, you consent to receive notices and responses electronically when permitted by law. You are responsible for maintaining an accurate email address and telephone number and for safeguarding access to your devices and accounts. Electronic communications may not always be secure, uninterrupted, or error-free.
When you separately opt in to receive text messages from Credence, you authorize us to send messages to the number provided concerning insurance inquiries, quotes, applications, policy services, renewals, reminders, and related marketing where permitted. Message frequency varies. Message and data rates may apply. Consent to marketing texts is not a condition of purchasing insurance. Reply STOP to opt out and HELP for assistance, or contact 612-293-8228 or nyang@credencera.com. After an opt-out request, you may receive one confirmation message. Not all carriers are supported, and delivery is not guaranteed. Your mobile carrier is not liable for delayed or undelivered messages. We will honor legally valid revocation requests as required by applicable law.
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Additional insurance carrier, MGA, platform, or financial privacy notices may apply.
The website and its text, graphics, logos, design, arrangement, and other content are owned by Credence or used with permission and are protected by applicable intellectual-property laws. You may view and print reasonable portions for your personal insurance needs. No other reproduction, modification, distribution, commercial use, or creation of derivative works is permitted without prior written consent.
Links or integrations may lead to carrier, EZLynx, payment, social media, or other third-party services. We do not control and do not endorse or guarantee third-party content, availability, security, products, or practices. Your use of third-party services is governed by their terms and privacy policies.
We try to maintain accurate and useful information but do not warrant that the website will be uninterrupted, secure, error-free, complete, current, or suitable for every purpose. To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
To the fullest extent permitted by law, Credence and its directors, officers, employees, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or losses arising from reliance on website content, inability to use the website, third-party services, or electronic transmission failures. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
To the extent permitted by law, you agree to indemnify and hold Credence harmless from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the website, your material violation of these Terms, or information you knowingly submit without authority. This section does not require indemnification for Credence’s own unlawful conduct.
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except to the extent federal law or the mandatory law of another jurisdiction applies. Any dispute not subject to a mandatory administrative process will be brought in a court of competent jurisdiction in Minnesota, unless applicable law requires otherwise.
We may revise these Terms by posting an updated version and date. Changes apply prospectively when posted unless a later date is stated. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.
